MONTGOMERY, Ala. (AP) — Alabama Chief Justice Roy Moore says he is disappointed that a majority of the state’s probate judges are giving marriage licenses to same-sex couples.

Moore on Feb. 8 directed probate judges to refuse the licenses because they were not under direct court order from the federal judge that ruled the state gay marriage ban unconstitutional. Some judges are following his advice, but others are not.

The chief justice said state courts will be bound to follow a U.S. Supreme Court ruling on gay marriage later this year. However, he said he would consider a ruling legalizing gay marriage among the high court’s greatest mistakes.
