CHATTANOOGA, Tenn. (AP) — A transcript from Republican Rep. Scott DesJarlais’ divorce case is being released the day before Tuesday’s election.

Gerard Stranch, a Tennessee Democratic Party attorney who asked a court to release the record on the grounds that voters needed the information, announced Monday in Chattanooga an agreement with the congressman’s lawyer to provide a transcript. DesJarlais’ attorney, Harvey Cameron, confirmed the development.

The exact time the document will be available wasn’t immediately known.

Records from the 2001 divorce earlier revealed that DesJarlais, who opposes abortion rights, once urged his girlfriend to have an abortion. The revelation boosted the campaign of the Democratic challenger, state Sen. Eric Stewart.

The impact of the latest release isn’t certain. More than 120,000 ballots were cast in the 4th District during early voting.
