Auburn Tree Killer Assaulted After Court Appearance

The Alabama Crimson Tide fan that is accused of poisoning the historic trees at Auburn’s Toomer’s Corner was assaulted just minutes a leaving an Opelika courthouse.
Opelika police said Harvey Updyke Jr. was attacked Wednesday afternoon when he stepped out of his car at a gas station. Capt. Allan Elkins said Updyke believes there was more than one person involved and that he was punched in the head, but didn’t see who did it.
Updyke’s attnorney Glennon Threatt spoke with WBRC Fox-6 Birmingham following the attack on client.
Updyke was treated and released at East Alabama Medical Center with several small bruises and scratches.
Elkins said whoever is responsible could face misdemeanor charges, but that there were apparently no witnesses and the store did not have video surveillance.
